开发商Mady拥有40年的经营历史,建设过1500多高级公寓项目,还有不少的退休社区及零售项目。

由于地下水及交工延迟等原因导致位于 144 Park Street的公寓项目陷入困境,尽管149个单元已经售出129个,仅有20个单元没被售出,但开发商欠下4000万贷款和300万的工程款,由于欠款存在,住户们暂时将不能拿到产权。法院委任的代理人将其余下20套房产售出,并注册此公寓的Plan, 到时业主也能拿到产权(Ownership). 不过在这过程中,业主还要付租金的哦。


WATERLOO — Groundwater problems and delays have forced a court-appointed trustee to step in and sort out a mess of debts and incomplete sales at the upscale Waterloo condo project 144 Park.
Collins Barrow Toronto Limited was appointed in January to finalize the sale of 129 already-occupied units and deal with at least $40 million in outstanding mortgages and $3 million in construction liens on the Mady Group project, according to court documents.
Residents Scott Cruickshank and Kerry Mueller said the trustee appointment is a good thing for people living at 144 Park. Once the condo plan is registered they can take ownership of their homes.
"It's actually a positive outcome for the residents," Cruickshank said.
He moved in to his home in April and said residents understood it might take time for sales to be finalized. In the meantime residents pay rent.
The project is located at 142, 144 and 148 Park Street and 21 Allen St. W. in Waterloo.
Mueller moved in last August and shared Cruickshank's sentiments.
"We've been really happy being here," Mueller said.
Mady Group sought the trustee appointment after defaulting on its mortgage.
Of the 149 units in the 19-storey building, 129 are sold and owners have been in their residences for several months. But after liens were registered against the property Mady was unable to close the sales and provide purchasers with their title documents.
Two penthouses, 15 apartment units and three townhouse units had not been sold as of January.
Between October 2014 and Jan. 15, $3 million in construction liens were registered against the property by 17 contractors.
The trustee will finalize the condo sales, finish registering the plan of condominium with the Region of Waterloo and City of Waterloo and hire a contractor to complete the necessary work on 20 unfinished units that would allow them to be sold and the money used to settle debts.
Waterloo interim director of planning approvals Joel Cotter said the city and region are working to get the condo plan registered.
City chief administrative officer Tim Anderson said there was no indication the project was struggling.
"Not during the construction phases, no," Anderson said. "On that particular property in fact they have an ultimate vision to twin the site with another tower, so that's sort of where the city's vision (is) and ultimately we would like to see the property built, too."
The 144 Park project isn't Mady Group's only difficulty.
The company was granted protection in February under the Companies' Creditors Arrangement Act for a $100-million mixed-use project in Barrie, according to media reports.
Windsor-based Mady Group was founded more than 40 years ago and has built more than 1,500 condos, several retirement communities and retail projects.
Chief executive officer Chuck Mady could not be reached for comment.
